Acceptable Use Policy

About this policy

Together with our Terms of Use, this Acceptable Use Policy (the "Policy") will apply and govern how you may access and use the Bambino application, all associated web pages and all content contained on them (the "App"), upload or share material to our App through the chat or forum functionality ("User Content"), and interact with other users.

You should read this Policy carefully before using the App, and must comply with the standards in spirit as well as to the letter.

By using the App or otherwise indicating your consent, you agree to comply with this Policy. If you do not agree with or accept any part of this Policy, you must stop using the App immediately and delete the App from your mobile device(s).

In this Policy: 'we', 'us' or 'our' means Bambino Labs Ltd, registered under company number SC884324 and whose registered office is at Chapelton, Udny, Ellon, Scotland, AB41 6PX; and 'you' or 'your' means the person accessing or using the App or its content.

Bambino will determine, in its discretion, whether any User Content or your use of the App breaches these acceptable use standards.

Permitted Purpose

We permit you to use the App only for personal purposes and primarily for supporting your pregnancy experience through access to related resources, tools and forums. Use of the App in any other way, including any unacceptable use set out in this Policy, is not permitted.

Unacceptable use

You must not use the App:

• for any illegal purpose under any applicable law, including in any way that promotes or encourages any illegal activity, including fraudulent activity;
• to bully, insult, intimidate or humiliate any person (whether or not they are a user of the App);
• to send, knowingly receive, upload, download, share, post, use or re-use any material which does not comply with our content standards;
• to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware;
• for extracting, scraping, crawling or collecting data, including but not limited to via the use of web crawlers, bots, or spiders on the App;
• for use to generate prompts, requests, questions, instructions or similar in training AI models or any other form of automated content generation;
• to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
• for any 'phishing' activity (meaning to mimic communications from us or from someone else in order to collect identity information, authentication credentials, or other information);
• in any manner that disrupts the operation of our App, our business, or the website, app or business of any other entity;
• in any manner that is or could be harmful to children;
• to advertise, sell or attempt to advertise or sell any illegal, stolen or counterfeit goods or services;
• to falsely suggest that we endorse any business, product or service;
• to gain unauthorised access to or use of computers, data, systems, accounts or networks;
• to attempt to circumvent password or user authentication methods; or
• in any other manner which is prohibited by this Policy or by our Terms of Use.

User Content

All User Content must be accurate (where it states facts), only contain opinions which are genuinely held, and must comply with all applicable laws and regulations.

User Content must not:

• be defamatory of any person;
• be obscene, offensive, hateful or inflammatory;
• be abusive, incite hatred against or target any of the following characteristics: race, religion, sex, sexual orientation, disability, gender reassignment;
• infringe any copyright, database right, trade mark or any other intellectual property right of any person;
• include material that might impair the physical, mental or moral development of persons under the age of 18;
• be likely to deceive any person;
• breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
• contain illegal content or promote any illegal content or activity;
• be threatening, abusive or invade another's privacy, or cause annoyance, inconvenience or needless anxiety;
• impersonate any person or misrepresent your identity or affiliation with any person;
• give the impression that the User Content emanates from us, if this is not the case;
• advocate, promote, incite any party to commit, or assist any unlawful or criminal act;
• contain a statement encouraging or inducing acts of terrorism; or
• be pornographic.

Hidden advertising (where a content creator has been paid or otherwise has an incentive to endorse a product but does not clearly identify the content as advertising) is not allowed on our App.

Fake reviews are not allowed on our App. Fake reviews include reviews that conceal that the reviewer has been incentivised in some way to post the review, or where the review contains information that is false or misleading.

Breach

In the event of your breach of this Policy we may:

• terminate or suspend your access to and use of the App;
• take any other such measure as we consider reasonably necessary to remedy the breach.
